Terms and Conditions for approved Broodmares The following Terms and Conditions shall apply for any approved broodmare. These terms and conditions shall be enforced upon approval of the broodmare by Standing Stallions and affiliated parties. The owner/breeder will be notified of approval by phone, email or other approved forms of communication listed in the application. • The opening and closing of the breeding season shall be pursuant to the guidelines of the USTA and State of Ohio. Standing Stallions and affiliates shall have the right to make changes to this policy as long as it conforms to the published policies of the USTA and The State of Ohio. • In all cases where transported semen or live breeding is requested, the broodmare owner/breeder agrees that all costs relating to these procedures (other than the actual Service/Stallion fees), shall be paid by either VISA, MASTERCARD, AMERICAN EXPRESS or CASH before delivery of the semen. This applies unless other arrangements have been made in advance with Standing Stallions and Affiliates. • Neither Standing Stallions and Affiliates nor its directors, agents, or employees, shall be liable for any injury, disability or death suffered by any horse, from any cause whatsoever, while in the custody of Standing Stallions and Affiliates and the undersigned owner specifically assents to such conditions, and waives any claim from damages resulting from any such injury, disability, or death. • If using FedEx or UPS for semen delivery, the broodmare owner must have a valid account number. • Owner/Breeder and any third parties engaged by the Owner/Breeder performing the artificial insemination assumes liability and responsibility of ensuring the broodmare and labeled semen shipped by Standing Stallions and Affiliates match. Owner/Breeder and any third parties engaged by the Owner/Breeder must inseminate the broodmare with semen of the contracted stallion. Any variation of this shall be approved in advance. Only a contracted broodmare to that stallion shall receive the semen shipment. • All Service/Stallion fees shall be due and payable immediately when the broodmare produces a live foal as a result of this mating. A live foal is one that can stand up and nurse without assistance. Payment of Service/Stallion fee shall be made to the order of Standing Stallions and Affiliates. If the stud fee is not paid within 30 days of foaling, all promotional and/or discounts may be forfeited and the full stud fee plus a 1.8% handling charge may apply. • Any sale, transfer or change to ownership of the broodmare or a recipient mare the service/stallion fee is due and payable immediately. If the ownership is changed the Service/Stallion fee shall still be due. No refund shall be due to any person, under any circumstances. • In order to secure payment of agreed upon stud fee, the owner hereby consents that Standing Stallions and Affiliates shall have the right to pursue any legal means necessary to collect monies due for any foal resulting from the Service/Stallion but not limited to the stud fee, boarding charges, medication and/or veterinary Service/Stallions. Whether or not the broodmare or foal are at Standing Stallions and Affiliates the owner/breeder further consents to pay for all legal fees incurred by Standing Stallions and Affiliates if a third party is obtained for collection of outstanding balances due under this contract. • Standing Stallions, owners, affiliates and/or farm shall not be liable for, and is hereby released from, liability with respect to any cause of injury, disease or death to broodmare or foal resulting from breeding. Standing Stallions, owners, affiliates and/or farm reserves the right to reject any application or request further information or examination of the broodmare for potential breeding. After review of the Terms and Conditions above I the Owner/Breeder of reference hereby applies for a booking to the Stallion referenced in the Application. By applying my signature or Digital Signature/Mark I agree to be bound by all of the Terms and Conditions above. Upon approval of the broodmare designated, the Aforementioned document will become the permanent contract of breeding between the assigned Stallion and Broodmare. Any changes to this contract shall be in writing or digital format and approved by both parties (Owner/Breeder and Standing Stallions and Affiliates).
